Terms of Use

These terms are an agreement between you and Fadeaway ("Fadeaway", "we", "us") for your use of the Fadeaway Picks app and this website (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Play money only

Fadeaway is a free game for entertainment. Every stash, stake, payout and balance in the app is play money: it isn't real currency, has no cash value, and can't be deposited, withdrawn, transferred, sold or exchanged for anything of value. Fadeaway offers no prizes. Fadeaway is not a sportsbook and doesn't accept or facilitate real-money wagers.

You agree not to use Fadeaway to organize or settle real-money bets, side bets, buy-ins or prizes with other players. If you do, that arrangement is solely between you and them, and we may suspend the league or the accounts involved.

2. Who can use Fadeaway

You must be at least 18 years old to use the Service, and you must give us your true date of birth. You may have only one account, and you're responsible for keeping access to it secure and for everything that happens under it.

3. Leagues

A league's commissioner (the player who creates it) sets its rules, such as the weekly stash, minimums and season length, within the options the app provides. Results are calculated automatically from game results and odds supplied by third-party data providers.

Sports data can be delayed, incomplete or wrong. Games may be postponed or cancelled, and odds or results may be corrected after the fact. We may void, regrade or adjust picks, stashes and standings to correct errors or reflect official results, and our determination is final. Because nothing in Fadeaway has real value, these corrections have no monetary consequence.

4. Acceptable use

You agree not to:

• Choose a username or display name that is offensive, misleading, or impersonates someone else.
• Harass, threaten or abuse other players.
• Cheat, exploit bugs, or use bots, scripts or multiple accounts to gain an advantage.
• Access or try to access data that isn't yours, or interfere with the Service's security or operation.
• Copy, scrape, reverse engineer or resell any part of the Service.
• Use the Service in violation of any law.

5. Your content

You own what you put into Fadeaway, such as your username and league names. You give us permission to store, display and process it as needed to run the Service, including showing it to members of your leagues as described in our Privacy Policy.

6. Our service

We own the Service, including the app, its design and the Fadeaway name and logo. We grant you a personal, non-transferable, revocable license to use the app for its intended purpose. Team names, logos and other marks belong to their respective owners, and Fadeaway is not affiliated with or endorsed by any league, team or sportsbook.

We may change, add or remove features, or stop offering the Service, at any time. We're not liable to you for any such change.

7. Ending your account

You can delete your account at any time in the app under Profile → Delete account. We may suspend or close your account, or remove content, if you break these terms or to protect the Service or other players. Sections 1, 3 and 6 through 11 survive the end of your account.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, or that sports data will be accurate or timely. Nothing in Fadeaway is betting, financial or other advice.

9. Limitation of liability

To the fullest extent the law allows, Fadeaway and the people who build and run it won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to $50. Some places don't allow these limitations, so they may not all apply to you.

10. Indemnity

You agree to defend and hold harmless Fadeaway and the people who build and run it from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the Service, including any real-money arrangement you make with other players.

11. Disputes

These terms are governed by the laws of the State of Utah and of the United States, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be brought only in the state or federal courts located in Utah, and you and we consent to their jurisdiction. Before filing a claim, you agree to contact us at support@fadeawaypicks.com and try to resolve the dispute informally for at least 30 days.

12. Apple

If you downloaded the app from Apple's App Store:

• These terms are between you and Fadeaway, not Apple. Apple isn't responsible for the app, its content, maintenance or support, or any claims relating to it, including product liability, legal compliance or intellectual property claims.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.
• You confirm you're not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you're not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to these terms

We may update these terms. We'll post the new version here and update the effective date, and for material changes we'll tell you in the app before they take effect. If you keep using the Service after that, you accept the new terms.
